OGDEN — An Ogden man has been sentenced to prison in connection with a 2023 shooting in a parking lot on the north side of historic 25th Street in Ogden.

Second District Judge Matthew Hansen on Wednesday sentenced Marcellino Librado McCain, 22, to five years to life in prison for attempted murder, a first-degree felony, in the incident, which resulted in gunshot wounds to three men. The judge also sentenced him to a term of one to 15 years in prison for felony discharge of a firearm, a second-degree felony, to be served consecutively to the other term.

"On Jan. 22, 2023, defendant shot three people after an altercation on 25th Street in Ogden. Defendant admitted to getting into an argument with the three men and fired shots from a vehicle into the vehicle occupied by the victims," according to McCain's Feb. 17 plea agreement.

As part of the deal with prosecutors, two counts of attempted murder, two counts of felony discharge of a firearm and possession of a dangerous weapon by a restricted person, a third-degree felony, were dismissed.

McCain said he had been with two others at a bar, where his group got into an argument with someone else. McCain left and surveillance footage from a parking area north of 25th Street around Lincoln Avenue showed gunshots were subsequently fired from his vehicle into a vehicle containing the victims, according to charging documents. One victim was struck in the stomach area, another was hit in the head and another in the lip.

"McCain stated that after the altercation he'd gone to a friend's house, being given a ride from a female friend after buying tacos," the charges state.

McCain has a "minimal adult criminal history" but a rocky upbringing marked by "disruptions throughout his childhood" and substance abuse starting in his "early childhood," according to a mitigation report. For part of his youth he lived in foster care.

"McCain endorsed that he was raised by his grandparents up until the age of 12 and had witnessed various family members who were using substances, engaging in nefarious criminal acts or had severe mental health concerns," the report says.
