LAYTON — A man was charged with assault Wednesday after police say he crashed into a construction zone off Highway 89 and fled.

Marcos Daniel Archila Aquino, a 30-year-old Layton resident, "veered into a construction closure area and struck a parked work truck" on U.S. 89 near Antelope Drive on Oct. 26, according to charging documents.

A worker spoke with the driver, "and noted that he seemed drunk," before the driver "took off again, striking the worker and tossing him about 20 feet."

The Utah Highway Patrol was called to investigate, and a trooper later detained Aquino, noting that Aquino "smelled strongly of alcohol," charges say.

Aquino told police "he had 'two beers' in the park before driving," charging documents say, and failed field sobriety tests. The trooper reported "a mark on Aquino's hood where he had hit the worker."

Aquino faces one count of aggravated assault, a third-degree felony, one count of failing to remain at an accident, a class A misdemeanor, and a charge for driving under the influence, a class B misdemeanor.

No court date has been scheduled.
