TAYLORSVILLE — A man accused of stabbing his uncle to death was arrested early Sunday in Taylorsville.

Damon Michael Rushton, 26, was booked into the Salt Lake County Jail for investigation of murder.

Taylorsville police were called to a residence near 6400 South and 2700 West where they found Ruston's uncle, 39-year-old Patrick Rushton, dead on the floor.

Damon Rushton allegedly told officers "he stabbed his uncle after his uncle placed (Damon Rushton's) brother ... in a chokehold. Other family members said the uncle was trying to stop (the brother) from assaulting their father ... when the uncle intervened and then was stabbed by (Rushton)," according to a police booking affidavit.

Police on Monday said Damon Rushton and his 28-year-old brother, who live in the basement of the home, were drinking with their uncle when Patrick Rushton and the brother began fighting. Patrick Rushton placed the brother in either a chokehold or a headlock, prompting Damon Rushton to stab him once in the side, said Taylorsville Police Lt. Aaron Cheshire.

At least eight people were in the house at the time of the stabbing, he said.

Damon Rushton was booked into the Salt Lake County Jail just before 3 a.m.
