Ashton Jonathon Mann, 23, was charged Wednesday in 3rd District Court with manslaughter, a second-degree felony; and possession of a gun by a restricted person, a third-degree felony.

On Feb. 2, Unified police were called at around 12:30 a.m. to 5269 S. Charlotte Avenue, in Kearns, where Dylan Lee Treichel, 23, was found on the garage floor with a gunshot wound to his chest, according to charging documents.

Mann told police he lived at the house with Treichel, who is his best friend.

"Mann stated that … he and Dylan were playing a video game in the living room and then went to the garage to play with their guns. Mann stated that he dry-fired his gun six or seven times while Dylan was doing the same thing," the charges state.

Treichel then told Mann he could "dodge" a bullet.

"Mann told Dylan that he could not avoid being hit by something that went as fast as a bullet. Dylan asked Mann to take out the magazine and point the gun at him. Mann took the magazine out of his 9mm gun, put it on the table and racked it. Mann stated that he never keeps a bullet in the chamber because he doesn't have a concealed carry permit. Mann stated that he and Dylan were 'dry firing' — 'messing around' — when a round went off. Mann stated that after the round went off, he was in such shock he continued racking his gun. Mann stated that he wasn't even aiming at anything because he had his gun sideways," the charges state.

Mann called 911 and tried to render aid to his friend.

Because marijuana was also found in the home and Mann admitted to using it frequently, he is restricted from possessing a gun, the charges state.
