Salt Lake man gets 90-day jail sentence after admitting to having child pornography

SALT LAKE CITY — A Salt Lake City man has been sentenced to jail after he admitted to having 90 videos of child pornography on his phone in 2018.

Gustavo Briseno, 55, was sentenced Monday in 3rd District Court to serve 90 days in the Salt Lake County jail, according to court documents. He pleaded guilty in July to two counts of sexual exploitation of a minor, a second-degree felony.

Seven other counts of sexual exploitation of a minor were dismissed in the case as part of Briseno’s plea agreement, court documents show.

Briseno also received a prison sentence of one to 15 years in Utah State Prison on each felony count, but those sentences were suspended, according to the sentencing order. He was ordered to spend 48 months on probation and undergo assessment, including a psychosexual evaluation, to determine appropriate counseling and treatment, the order states.

Members of the Utah Internet Crimes Against Children task force were notified that a Google user may have uploaded child pornography in October 2017, according to charging documents.

Following that notification, Briseno voluntarily came to the Utah Attorney General’s office in April 2018 and was interviewed by agents, charges state. He admitted to investigators that "there were approximately 90 videos of child pornography on his phone," according to charges.

He also told investigators that he had had "a problem with child pornography for some time" and that he had been looking at child pornography as recently as four weeks before agents interviewed him, charges state.

Briseno was booked into jail on Monday, according to jail records.
